Obtaining Italian Citizenship From Female Ancestors

Under the Italian Law, a woman of Italian descent born before January 1, 1948 (the date on which Italy became a Republic) can only transmit Italian citizenship to her children born after January 1, 1948. This law is strictly enforced by all Italian Consulates in the USA. Consequently, if your paternal grandmother was born in 1920 & your father was born in 1942, you would not be eligible to apply through your grandmother.

Recently there was an important development regarding this law. A trial case challenged the law as discriminatory of Italian women by denying them the right to pass citizenship to their children. The High Court of Rome decided that this discrimination should cease, and granted the Italian citizenship to the woman’s descendant.

We collaborate with the law firm in Italy that won the first case and has been successful in winning over 100 cases. Considering this legal precedent, there is now a high probability of obtaining Italian citizenship via an Italian female’s ancestor that falls into this category.

You do not need to be present in Italy to participate in the trial and every member of your family (brothers, sisters, uncles, cousins, etc.) who share the same Italian ancestor can join the case. After a successful court case and the granting of the citizenship, the applicant(s) will be registered into the Italian civil registry as Italian citizens. The applicant(s) can then apply for an Italian passport at the Italian Consulate in their legal residence.

This path to Italian Citizenship can be made only in the Italian court system, and it is necessary to obtain the assistance of an Italian lawyer registered in an Italian bar association. We offer a phone consultation which includes the following:

  • Review of your specific situation and whether you qualify for this path to citizenship
  • Discuss the services that we can provide specific to your case
  • Estimated time frame and costs
  • Coordinate your referral for a no-cost online consultation with the attorney referral in Italy

The cost of the initial consultation is $80.00 payable by credit card at the time of your consultation.
