Obtaining Italian Citizenship through Female Ancestors

Under the Italian Law, a woman of Italian descent born before January 1, 1948 (the date on which Italy became a Republic) can only transmit Italian citizenship to her children born after January 1, 1948. This law is strictly enforced by all Italian Consulates in the USA. For example, if your paternal grandmother was born in 1920 & your father was born in 1942, you would not be eligible to apply through your paternal grandmother.

In 2009 there was an important development regarding this law. A trial case challenged the law as discriminatory of Italian women by denying them the right to pass citizenship to their children. The High Court of Rome decided that this discrimination should cease, and granted the Italian citizenship to the woman’s descendant.

We collaborate with the highly successful law firm in Italy that won the first case and has since won over 1000 of cases for descendants of women who were not eligible to apply for citizenship by descent at the Italian consulates or Towns in Italy under the 1948 law. Considering this legal precedent, there is now a high probability of obtaining Italian citizenship via an Italian female ancestor that falls into this category.

You do not need to be present in Italy to participate in the trial and every member of your family (brothers, sisters, uncles, cousins, etc.) who share the same Italian ancestor can join the case. After a successful court case and the granting of the citizenship, the applicant(s) will be registered into the Italian civil registry as Italian citizen(s) and are able to obtain Italian passports.
